REGULATIONS OF USING THE UNDERGROUND CAR PARK

AT THE ART HOTEL Sp. z o.o. IN WROCŁAW

§ 1

Organisation of the underground car park - garage

  1. The underground car park, hereinafter referred to as the Garage, is owned and managed by the Art Hotel Sp. z o.o. having its seat in Wrocław, ul. Kiełbaśnicza 20, 50-110, Wrocław, Poland, hereinafter referred to as the Art Hotel.
  2. The person using the Garage is hereinafter referred to as the User or the Rentee.
  3. The Garage is intended exclusively for parking passenger cars and motorcycles with combustion or hybrid engines, hereinafter referred to as “vehicles,” which means that parking of electric and gas-powered cars and motorcycles, as well as bicycles, is prohibited.
  4. The Garage comprises 32 parking spaces.
  5. The Garage is open 24 hours per day, 7 days per week.
  6. The pictograms and information boards placed in and around the Garage constitute an integral part of these Regulations.
  7. The Garage Users are obliged to strictly observe the information on the pictograms and information boards. The Garage is under video surveillance, which means it is continuously monitored, but it is not a guarded parking facility.
  8. By entering the Garage, the Vehicle User accepts these Regulations.

§2

Conditions for using the Garage

  1. The provisions of these Regulations are to be observed on the premises of the Garage.
  2. The User is obliged to comply with the traffic signs and other conditions for the use of the Garage to be found in the Garage as well as any other conditions made available to the User in connection with concluding the parking space rental contract.
  3. Renting a parking space in the Garage is based on the possibility of using the space on an hourly or daily basis, i.e. from 3:00 pm to 12:00 pm.
  4. The rental contract is concluded upon entry to the Garage. A proof of the contract is a parking ticket issued by the Garage Staff.
  5. The parking space rental fee is charged in proportion to the time of parking duration in accordance with the displayed price list for each occupied parking space (“Price List”).
  6. The payment for parking is to be made before leaving the Garage, at the Art Hotel reception.
  7. The payment for parking can be made by card or cash at the Art Hotel reception.
  8. The Art Hotel checks and makes sure the Guest paid the parking fee in the required amount before leaving the Garage. If not, the Art Hotels suspends the leaving process.
  9. The Art Hotel recognises a person in possession of a valid and paid parking ticket as authorised to enter and leave the Garage with the vehicle being driven.
  10. Entering and leaving the Garage is only possible in the presence and with the consent of the Art Hotel staff.
  11. Vehicles may only be parked in designated parking spaces indicated by designated Art Hotel staff member, with the exception of spaces that are clearly marked and reserved. If the User parks in a space that has not been assigned by an Art Hotel employee, Art Hotel reserves the right to charge an additional fee.
  12. In particularly justified cases, Art Hotel may decide to temporarily close the Garage or a part of it for use.
  13. Violating the Garage Regulations shall be subject to a fine amounting to PLN 500.
  14. In the event of a violation of the Regulations, abandonment of a vehicle in the Garage, or parking of a vehicle that poses a threat to the safety of other vehicles or to the health or life of Art Hotel employees or Users, Art Hotel reserves the right to remove the vehicle at the User’s cost and risk. Art Hotel shall not be held liable for any damage caused to the vehicle in connection with its removal under the above-mentioned circumstances.

§ 3

Safety Regulations

  1. The maximum speed in the Garage is 5 km/h.
  2. Moreover, in the Garage, it is forbidden to:

1) smoke tobacco and use open fire;

2) drink alcohol;

3) tank up vehicles and change fluids, coolants, fuel or oil;

4) leave the vehicle with the engine running and/or unsecured against self-movement;

5) park vehicles with leaking systems and/other parts;

6) for unauthorised persons, to stay in the Garage;

7) stay longer than it is required to put the vehicle in the Garage or take it out of the Garage;

8) leave pets unattended inside the car;

9) repair, clean and vacuum the vehicle;

10) store fuels, flammable substances and empty fuel containers;

11) contaminate the Garage;

12) park of vehicles with a weight exceeding 3.5 tons which is prohibited without the consent of Art Hotel.

4. The control of the compliance of the parking of vehicles with these Regulations is carried out by persons authorized by Art Hotel.

§ 4

Liability of the Art Hotel

  1. The Art Hotel shall not be liable for any damage to, destruction or loss of a vehicle caused on the Garage premises through the fault of the User, third parties or force majeure.
  2. The Art Hotel shall not be liable in particular for:

a. belongings and pets left inside the vehicle;

b. theft of the vehicle from the parking space;

c. any sudden and unforeseen events arising independently of the will of the Art Hotel;

d. bumps and collisions;

e. damage caused by third parties;

as the Art Hotel merely provides the User with a paid parking space for use and does not offer vehicle or property protection services, the parking area is monitored but not guarded.

3. The Art Hotel is liable for any damage caused through the sole fault of the Art Hotel employees. The User is obliged to immediately notify the Art Hotel about the damage occurred and the circumstances of the damage. Any claims in this respect shall only be considered if discovered before leaving the Garage.

4. Any damage caused to the vehicle on the premises of the Garage is removed within the confines of the mandatory third party liability insurance of the damage culprit.

§ 5

Liability of the User

  1. The User is liable for any damage caused to third parties within the Garage by themselves, their employees, contractors, or accompanying persons. The User is also responsible for any contamination caused in the Garage, regardless of its source. The User is obliged to immediately inform the Art Hotel reception staff about the incident and to submit a statement no later than before leaving the Garage.
  2. The User is obliged to secure their vehicle against unauthorised access and apply the security systems installed in their vehicle.
  3. The User is obliged not to leave any pets or any things which are not elements of the factory equipment of their car inside the vehicle.

§ 6

Amendments to the Regulations

  1. The Regulations and the Price List are available on the website www.arthotel.pl.
  2. The prices listed in the Price List are gross prices. Art Hotel reserves the right to amend the Regulations and the Price List at any time by publishing the changes on the website www.arthotel.pl.
  3. These Regulations are effective as of April 1, 2025.
